Mexico City, December two5 (RT).- The ex -componers of the legendary American rock band Nirvana have presented this Wednesday a motion to dismiss the demand imposed in August for alleged child pornography for "the baby" that appears on the cover of his album Nevermind.

Spencer Elden, who is currently30 years old, was photographed naked when he was a baby for the iconic cover of the album, and now alleges that Nirvana, record companies and art directors violated federal laws on child pornography.

In particular, Elden states that his parents never signed an authorization that allowed the band to use the photo, taken in a Pasadena Aquatic Center in 1990, and that he never received compensation for it.

However, Bert H.Deixler, a lawyer for the ex -componers of Nirvana, argues in the recent motion that Elden's demand not only arrives with decades of delay, but "is not serious", so he has asked the judge to dismiss her.
